Lumlu Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and Lumlu LLC ("we", "us", "our") governing your use of the Lumlu application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms, our Acceptable Use Policy, and our Privacy Policy, each incorporated by reference. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you are under the age of majority, you may use the Service only with the involvement of a parent or guardian.
2. Your Account
The Service creates an anonymous device account so you can use it without signing up. You may optionally link a sign-in identity to sync across devices and to enable additional features. Linking is durable: an identity cannot be unlinked from within the app — to remove it, delete your account. You are responsible for activity that occurs under your account and for keeping your sign-in credentials secure. One person's account spans all devices linked to the same sign-in identity.
3. Your Content
"Your Content" means documents (such as PDFs) you import, and the study material you create or generate from them — flashcards, notes, highlights, and anchors.
- You retain ownership of Your Content. We do not claim ownership of it.
- You grant us a limited, worldwide, non-exclusive license to host, process, transmit, and display Your Content solely to operate and provide the Service to you (for example, to store your study material, sync it across your devices, generate study aids, and deliver shares you create). This license ends when you delete the content or your account, except for content you have shared with others (which persists until removed) and routine backups.
- You are solely responsible for Your Content and for having the rights necessary to import, store, generate from, and share it.
4. Sharing
The Service offers two kinds of sharing:
- Public study sharing (free). You can publish the study layer only — flashcards, notes, anchors, and any images or audio attached to them, along with the share's title, subject, and the source document's title — as a link anyone can open. Public shares never include the source document/PDF; recipients re-link their own copy. Anything you publish publicly is accessible to anyone who has the link, and you can optionally list a share in the public Explore gallery, where anyone can discover it without the link. Do not publish content you are not permitted to share publicly.
- Private sharing (premium). Eligible accounts may share content, which can include a source document, privately between signed-in users. You are responsible for ensuring you have the right to share any document you include.
You must not share content that infringes others' rights or violates the Acceptable Use Policy. We may remove any shared content and revoke any share at any time.
5. AI-Generated Study Material
The Service uses automated and AI systems to generate study material from your documents. AI output may be inaccurate, incomplete, or misleading. It is provided for study assistance only, is not professional, legal, medical, financial, or academic advice, and should be independently verified. Generation may be metered by credits and subject to fair-use limits, which we may change. The third-party providers that process your content for these features are listed in the Privacy Policy.
6. Acceptable Use
You agree not to misuse the Service. Prohibited content and conduct are described in the Acceptable Use Policy. Violations may result in content removal, suspension, or a permanent ban of your account and all linked devices.
7. Intellectual Property and Copyright
You must own, or have the necessary rights to, any document you import, generate from, or share. We respect intellectual property rights and respond to valid copyright notices. To report infringement, contact legal@lumlu.app with the information required by applicable law (identification of the work, the material at issue and where it is located, your contact information, a good-faith statement, and a statement under penalty of perjury that you are authorized to act). We may remove infringing material and terminate repeat infringers.
8. Reporting and Moderation
Shared content can be reported from within the Service. We also use automated tools to help keep public surfaces safe: text you publish publicly may be scanned by AI-based classifiers, and images you upload may be checked against hash databases of known child sexual abuse material. Automated flags are generally reviewed by a human, and automated systems may hide or restrict content pending that review. We review reports and may remove content, revoke shares, and suspend or ban accounts that violate these Terms or the Acceptable Use Policy. We are not obligated to monitor content but may do so.
9. Subscriptions and Billing
Paid features are sold as subscriptions through the Apple App Store or Google Play. Payment, billing, auto-renewal, and cancellation are handled by the applicable app store under its terms; manage or cancel your subscription in your app store account settings. Subscriptions renew automatically until cancelled. Except where required by law or the app store's policies, payments are non-refundable and we do not process refunds directly. Prices and plan features may change on a prospective basis.
10. Suspension and Termination
You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms or the Acceptable Use Policy, or to comply with law or protect the Service or its users. Provisions that by their nature should survive termination will survive.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or the rights of others.
14. Changes to These Terms
We may update these Terms from time to time. Material changes take effect on the new effective date shown above. Your continued use of the Service after changes take effect constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the State of North Carolina, United States of America, without regard to its conflict-of-laws rules, except where mandatory local consumer-protection law applies.
